Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue any writ, order or direction more particularly in the nature of MANDAMUS. thereby declare the inaction of the Respondents over the representations of the Petitioner dated 01.03.2019, 11.03.2019, 15.04.2019, 27.01.2020 and 29.01.2021 with regard to his seniority vis-a-vis the seniority of Respondent No.3 as irrational, manifestly arbitrary, malafide and violative of Articles 14, 16 and 21 of the Constitution of India and consequently direct the Respondents to include the name of the Petitioner in the final seniority list of Deputy Executive Engineers (RandB), Zone-III, for the year 2011-2012 over and above the Respondent No.3 at S.No.13 as communicated vide Circular Memo No. 3940/Ser-I(3)/2015 dated 06.03.2019 and to pass

The Court made the following ORDER:

Learned counsel for the petitioner seeks permission of this Court to withdraw the present writ petition.

Permission is accorded.

Accordingly, the Writ Petition is dismissed as withdrawn. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
