Petition under Sections 10 to 12 of Contempt of Courts Act 1971 praying that in the circumstances stated in the affidavit file herein the High Court may be pleased to Pleased to punish the respondents under Section 10 to 12 of the Contempt of Courts Act for willful disobedience of the orders dt.04.07.2024 passed in W.P.No.13998 of 2024 in the interest of Justice.

The Court made the following:

ORDER:

This Contempt Case arises from the order dated 04.07.2024 in W.P.No.13998 of 2024. The said Writ Petition was filed asserting that the petitioner is a recognized institution and the Government had admitted the grant-in-aid posts, and out of seven sanctioned working posts, four posts are vacant. Therefore, the above Writ Petition is filed to fill up the vacant aided posts as per G.O.Ms.No.40 dated 30.06.2017. This Court has disposed of the Writ Petition, vide order dated 04.07.2024, following the judgment of a co-ordinate bench of this Court in W.P.No.30927 of 2022 and batch dated 05.01.2023, directing the respondents to pass appropriate orders, keeping in view the guidelines prescribed by this Court in W.P.No.30927 of 2022 and batch dated 05.01.2023. For non-compliance of the said order dated 04.07.2024 in W.P.No.13998 of 2024, the present Contempt Case is filed.

2. Learned counsel appearing for the respondents would submit that the petitioner institution had 73 students and the strength of the institution is two grant-in-aid posts, as per the pupil teacher ration at the time of disposal of the Writ Petition. Now the strength of the institution has been increased to 101 and the petitioner herein filed an application before the authority for sanction of posts. For non-consideration of the application, the petitioner herein filed W.P.No.33971 of 2025 and the same has been disposed of directing the respondents herein to consider the case of the petitioners in terms of the order dated 05.01.2023 in W.P.No.30927 of 2022 and batch.

3. The contention of the respondents is that the petitioner is having only strength of 73 posts at the time of disposal of the Writ Petition. According to the strength, the Government had granted two aided posts applying teacher and pupil ratio and therefore, the respondents have complied with the orders of this Court. The petitioner has filed another Writ Petition for additional posts and the same was disposed of in favour of the petitioner.

4. Recording the same, the Contempt Case is closed. There shall be no order as to costs.

As a sequel thereto, Interlocutory Applications pending, if any, shall stand closed.
