The Court made the following:

ORDER

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

“…to issue a writ, order or direction, more particularly one in the nature of writ of Mandamus, declaring the action of the respondent No.4 in issuing the impugned endorsement in Rc. No. 386 / 2025-A, dated 24.01.2026, rejecting the petitioner’s application for issuance of a Family Member Certificate, on the ground that the petitioner / mother cannot be treated as a family member of her deceased married son and without affording any opportunity of hearing to the petitioner, as illegal, arbitrary, unjust, violative of principles of natural justice and violative of Articles 14 and 21 of the Constitution of India, and consequently set aside the said impugned endorsement and direct the respondents, particularly the respondent No.4, to issue a Family Member Certificate by including the name of the petitioner as mother of the deceased, after issuing notice to all concerned and conducting due enquiry, within the time fixed by this Court, and pass such other order or orders as this Court may deem fit and proper in the circumstances of the case.”

The case of the petitioner, in brief, is as follows:

The petitioner is the mother of Mandula Moulali, a Police Constable, who died committing suicide on 01.06.2025. The petitioner submitted an application, dated 01.06.2025, to the respondent No.4 through online / Meeseva, vide application No. FMC25101005124, to issue a family member certificate for the purpose of availing legal benefits. The petitioner was shown as nominee in the service record of Mandula Moulali. On the application of the petitioner, instead of conducting a proper enquiry by issuing notice to the petitioner and all parties concerned, the respondent No. 4 rejected the request of the petitioner, vide endorsement in Rc.No.386/2025-A, dated 24.01.2026, on the ground that there were certain family disputes and that a suit in O.S. No. 76 of 2025 was pending before a competent civil Court. The petitioner, being a mother, is entitled to a family member certificate.

Hence, this writ petition was filed challenging the endorsement.

The learned Assistant Government Pleader for Revenue placed on record a copy of the written instructions of the respondent No. 4 vide Roc. No. 386/2025-A, dated 14.06.2026, wherein it was mentioned as follows:

“On perusal of the available records, the petitioner i.e., Smt. Mandula Khasim Bi, W/o. Khadar Mastan is the ordinary resident of Vipparla village of Rompicherla Mandal, of Palnadu District. The petitioner’s son was selected as Police Constable and working in A.P.S.P. Battalion, Venkatagiri of Tirupathi District. The petitioner performed marriage of her son, Mandula Moulali, on 09.11.2023 with Shaik Fathima, R/o. Maruthi Nagar, Guntur. Due to family disputes, Sri Mandula Moulali had filed a divorce petition in O.S.No.76 of 2025 before the Narasaraopet Court on 07.01.2025. While the said case was still pending, he committed suicide and died on 01.06.2025 in an agricultural field situated at Chinna Kothapalli Village, Addanki Mandal, Bapatla District. In view of the death of Sri Mandula Moulali, the Hon’ble I Additional Junior Civil Judge Court dismissed the divorce petition in O.S.No.76 of 2025 pending before it.

Further, Smt. Shaik Kasimbi, W/o. Khader Mastan submitted an application for issuance of a Family Member Certificate for the purpose of claiming the death benefits of her deceased son. However, the Tahsildar office, Rompicherla reported that since Sri Mandula Moulali was married, his mother cannot be issued a Family Member Certificate in respect of him.

Therefore, in view of the above circumstances, after the marriage of Sri Mandula Moulali, S/o. Khader Mastan, only his wife and children (if any) can be considered as his family members. Further,
