By the batch of appeals, a challenge has been made to the order dated 29.09.2022 passed by the Adjudicating Authority answering the reference and confirming the attachment of properties by the Initiating Officer, Benami Prohibition Unit, Nagpur.

Brief facts of the case:

2. The Initiating Officer, Benami Prohibition Unit, Nagpur made six references under Section 24(5) of the Prohibition of Benami Property Transactions Act, 1988 (in short ‘the Act of 1988‟) and caused six Provisional Attachment Orders on FPA-PBPT-2608 to 2618/NGP/2023, FPA-PBPT-2634 to 2682,2685-2697/NGP/2023, Page 3 of 17 28.05.2022 under Section 24(4) of the Act of 1988. The Initiating Officer provisionally attached 870 bank accounts in Buldana Urban Cooperative Credit Society Ltd. (hereinafter referred to as ‘the C0-operative Society‟). The total amount lying in different bank accounts of the appellants was totalling Rs.42.358 Crores and has been attached.

3. It was found that substantial amount of cash has been deposited in 718 newly opened non-PAN accounts and 53 old inactive accounts in the Co-operative Society, Dharmabad Branch and 118 non-PAN bank accounts in Sarafa Branch of the Co-operative
