FINAL ORDER

10.12.2025 By batch of these appeals under Section 26 of the Prevention of Money Laundering Act, 2002 (in short `the Act of 2002’), a challenge has been made to the order dated 03.10.2023 passed by the Adjudicating Authority confirming the Provisional Attachment Order dated 07.07.2014 for which Original Complaint was filed on 26.12.2021 before the Adjudicating Authority for its confirmation. The Adjudicating Authority has confirmed the Provisional Attachment Order vide the impugned order and accordingly aggrieved by the said order, appeals have been preferred by the appellants.

Brief facts of the case:

2. It is a case where an FIR was registered by CID, Meghalaya on 26.04.2013 against CMJ University for commission of offence under Section 420,406,466 of IPC, 1861. Proceeds of crime determined by CID, Meghalaya was for a sum of Rs.83,52,68,953/-. The ECIR was thereupon recorded by the respondents on 07.07.2014 naming few appellants and CMJ University, Shillong at the initial stage. After investigation, charge sheet was filed by CID, Meghalaya before the Chief Judicial Magistrate, Shillong on 20.04.2015. The investigation was caused by the respondents and finding proceeds of crime in the hands of the appellants, their movable and immovable properties worth of Rs.13,54,14,677/- (Movable Properties totalling to Rs.9,76,06,177/- and immovable properties totalling to Rs.3,78,08,500/-) were attached. It was apprehending concealment or transfer of the property so as to frustrate the proceedings of confiscation.

3. The allegation against the CMJ University is in regard to the issuance of fake degrees to the students. In the investigation, it was revealed that after establishment of the CMJ University vide Notification dated 17.06.2010, it started functioning officially on 17.10.2010 as per CMJ Founda
