This Order would dispose of the Appeals No. FPA-FE-300/HYD/2009 and FPA-FE-301/HYD/2009 filed by the Appellants Shri M. Ramesh Babu and M/s Sree Sanjay Agro Trading (Pvt.) Ltd. respectively. Ld. Special Director, Enforcement Directorate, New Delhi vide Order No. SDE(PKD)/VI/3/2008 dated 15.09.2008 (Impugned Order) imposed penalty of Rs. 25 lakhs and 5 lakhs on the Appellant Company and the individual Appellant respectively, for the contravention of Section 7 and 8 of the Foreign Exchange Management Act 1999 (FEMA) r/w Regulations 8, 9 & 13 of Foreign Exchange Management (Export of Goods and Services) Regulations 2000 (Regulations). The aforementioned contraventions were r/w Section 42(1) of FEMA with respect to the penalty imposed on the individual Appellant, on account of him being Managing Director of the Appellant Company at the relevant time.
