JUDGMENT :
1. Heard Mr Preetam Talaulikar for the Petitioner, Mr Deep Shirodkar, Additional Government Advocate for Respondent No.1, Mr S. Priolkar, Additional Government Advocate for Respondent No.2, Mr P. Shirodkar with Ms A. Rane for Respondent No.4, Mr S.D. Lotlikar, Senior Advocate, with Ms S. Kenny for Respondent No.5 and Mrs A.A. Agni with Ms J. Sawaikar for Respondent Nos.6 to 10.
2. Rule. The rule is made returnable immediately with the consent of the learned Counsel for the parties.
3. In Writ Petition No.472/2022(f), the challenge is to the Trial Court's order dated 16.12.2021 dismissing the Petitioner's (original plaintiff) application for adding parties by resorting to the provisions of Order I Rule 10 of CPC. In Writ Petition No.473/2022(f), the challenge is to the Trial Court's order dated 16.12.2021 dismissing the Petitioner's application to amend the plaint by resorting to Order VI Rule 17 of CPC. The addition of parties was proposed due to the amendment sought. Accordingly, the learned Counsel for the parties agree that both these petitions can be disposed of by a common judgment and order.
