ORAL JUDGMENT:

The petitioners are assailing the order dated

4.10.2021, rendered by the Joint Registrar, Co-operative

Societies, Nagpur, whereby the revision preferred by the

petitioners challenging a recovery certificate issued under

section 101 of the Maharashtra Co-operative Societies Act,

1960 is rejected on the ground that the mandatory pre-deposit

condition is not complied with.

2.

I see no error in the order impugned since the

condition of pre-deposit of 50 percent of the amount due and

payable is mandatory. It would not be permissible for the writ

Court to interfere with the order impugned.

3.

The petition is dismissed.
