The appeal is filed against the judgment and

decree of Regular Civil Appeal No.133 of 2008 which was

pending in the Court of District Judge-1, Osmanabad. The

First Appellate Court has set aside the judgment and

decree of Regular Civil Suit No.74 of 2003 by which the

suit of the present respondents was dismissed. The First

Appellate Court has granted relief to respondents /

plaintiffs of declaration of ownership and injunction. Both

sides are heard.
