1. Heard the learned Advocate for the

Applicants and the learned APP for the State.

2. The applicants are seeking bail in

C.R.No.50 of 2008 of Akluj police station,

Solapur. The said case is under Sections 147,

148, 149, 307, 341, 323 and 504 of IPC and Section

135 of the Bombay Police Act.

3. The case of the injured person, who is

complainant, is that Maruti Ankure assaulted him

with sword on the head and thereafter the present

applicant No.1 assaulted him with a stick of spade

on his back and waist and the other applicants

assaulted him with fist and kick blows.

4. In the present case, the investigation is

over and the charge-sheet has been filed. Only

one injury was found on the body of the injured

witness i.e. CLW on the head. The said injury is

not consistent with assault by sword. Moreover,

there is nothing to show that the injury was

grievous in nature. Looking to these facts, I am

inclined to grant bail to the applicants.

5. The applicants - Pinto @ Pratap Vasant

Bhosale, Santosh Kashinath Jadhav, Umesh Jadhav,

Subhash Dattu Dhorkar & Suresh Ambare Namdev to be

released on bail in the sum of Rs.25,000/- each

with one or two sureties to make up the said

amount. The applicant shall report to Akluj

Police Station, Solapur once in a week, till

conclusion of the trial.

6. Criminal Application is disposed of

accordingly.
