3. The challenge raised in the present application filed under Section 482 of the Code of Criminal Procedure to the Chargesheet dated 21.10.2022 bearing No.283 of 2022 dated 21.10.2022 filed in FIR No.431 of 2022 dated 16.03.2022 registered with Police Station Wardha, for the offences punishable under Sections 306 read with Section 34 of the Indian Penal Code (hereinafter referred to as “IPC”).

4. From the report, it is evident that the applicant is an employee of Zilla Parishad School at Kachnur. At the relevant time, the deceased who committed suicide was working as Headmaster. Whereas, the applicant was the teacher in the said school. The allegations against the applicant is that, he used to call the applicant ‘‘gkreksMs** because of some deformity in his hand. It is alleged that there was lot of harassment by the applicant to the deceased and even he made false complaint against the deceased and therefore, he committed suicide by hanging himself.

5. We have heard the learned counsel for the respective parties. 6. Shri Sambre, learned counsel for the applicant submits that since the pre-requisite to constitute offence under Section 306 of the IPC are absent, the chargesheet needs to be quashed and set aside.

In the report, certain serious allegations were made against the deceased regarding his behaviour with fellow staff being Headmaster. 13. The record further shows that, the deceased removed some students from the school and treating this as a misconduct, a departmental inquiry was initiated against him.
