1. On 17th December, 2021, this Court [Coram: Nitin Jamdar (as is Lordship then was) & Sarang V. Kotwal, JJ.] had passed the following order:-
“ . Heard the learned counsel for the parties.
2. The learned counsel for the Petitioner makes a grievance that, even though the complaints have been made by the Petitioner from 11 March 2014 as regards offence of cheating to which the Petitioner was a victim, no F.I.R. is lodged. It is submitted that one Mohanlal Agrawal was another victim of similar fraud played and his case was lodged in which the charge-sheet is filed and therein the Petitioner is made as a witness. The learned counsel for the Petitioner submits that no recovery of whatsoever nature is made even though amount of fraud is up to the tune of Rupees Ten Crores. The learned counsel for the Petitioner submits that in the case of Petitioner the investigation is deliberately faulted by the investigating officer who was assigned the investigation.
