PC:-

1. Pursuant to order dated 12th December 2025, a

compliance report of surety is received by the Registrar

(Judicial-1) and is placed before the Court today. As per the

said Report, the Applicant has made a false statement that

surety papers have not been accepted by the Trial Court and

learned Trial Court has specifically stated that the Applicant

has not understood the difference between “acceptance of

surety papers” and “acceptance of the suretyship” by the order

of this Court.

2. On being faced by this Report, Mr. Rajendra Bidkar,

learned counsel appearing for the Applicant, states that it is

not that the surety papers not accepted by the Court but

because of the absence of ‘Occupation Certificate’ of the flat of

the brother-in-law of the Applicant, there is an inquiry

pending and because of the said inquiry, there is delay in

acceptance of the surety papers.

3. Be that as it may, the Applicant has sought modification

of order dated 17th November 2025 wherein the Applicant is

enlarged on bail on execution of P. R. Bond in the sum of

Rs.50,000/- with one or two local sureties in the like amount.

Since the Applicant is yet constrained to remain in jail because

of the said enquiry, it is directed that he be released on cash

bail of the same amount for a period of 4 weeks from today.

4. In the meantime, enquiry will proceed regarding the

sureties.

5. The order dated 17th November 2025 is modified

accordingly. The Trial Court is requested to release the

Applicant on cash bail in the sum of Rs.50,000/- for a period

4 weeks from today.

6. Rest of the order remains as it is.

7. Interim Application is allowed and accordingly, disposed

of.
