2. This is an application for Anticipatory Bail.

3. The applicant is apprehending his arrest in Crime No. 695 of 2025 registered at Malwani Police Station, for the offences punishable under Section 69 of the Bharatiya Nyaya Sanhita,

2023.

4. It is the case of the prosecution that on multiple

occasions the applicant, on the false promise of marriage, subjected the victim to forcible sexual intercourse.

5. I have heard the learned counsel for the applicant, the learned APP for the respondent-State and the learned counsel for the respondent No.2/victim.

6. The learned counsel for the applicant submits that the applicant and the victim were in love relationship. It is submitted that the alleged relationship was consensual.

7. On the other hand, the learned APP for the respondent- State submits that, considering the nature of crime, the applicant may not be released on anticipatory bail.

8. The learned counsel for the respondent No.2/victim submits that the victim, who is present in the Court, has no objection if the present applicant is released on anticipatory bail.

9. I have perused the First Information Report. Prima-facie, the alleged relationship between the applicant and the victim appears to be consensual. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

O R D E R

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 695 of 2025 registered at Malwani Police Station, for the offences punishable under Section 69 of the Bharatiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.
