HIGH COURT OF BOMBAY
Madhav J. Jamdar, J
Bhushan Chandrakant Kasar – Appellant
Versus
State of Maharashtra – Respondent
ANTICIPATORY BAIL APPLICATION NO.2595 OF 2025

Advocates:
For the Appellants/Petitioners: S. A. Dighe
For the Respondents: R. V. Newton, Shubham Gharbudave

Grant of anticipatory bail is permissible when the investigation is complete and the chargesheet is filed, provided stringent conditions are imposed to prevent the accused from influencing witnesses or the victim.

Headnote:The Applicant seeks pre-arrest bail under Section 482 of the Bharatiya Nagarik Surakhsa Sanhita, 2023, in connection with C.R. No.406 of 2025 registered for offences under Sections 74 and 78 of the Bharatiya Nyaya Sanhita, 2023, and Sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012. The prosecution alleges that the Applicant attempted to molest the victim on 09th August 2025. The Court noted that the chargesheet was filed on 06th October 2025, indicating the completion of the investigation. The primary issue concerned the potential for the Applicant to influence the witness or the victim given that both parties reside in the same locality. The Court reasoned that since the investigation is completed, the necessity for custodial interrogation is diminished, provided that stringent conditions are imposed to prevent the Applicant from entering the victim's village. The Anticipatory Bail Application is disposed of accordingly.
