Interim Application No. 19476 of 2022 :

1. This Application is not on Board. By consent of the parties, taken on Board.

2. This Interim Application seeks to enhance the claim of the original claimant in the cross-objections.

3. Mr. Punde, learned Counsel appears and submits that the claim in the cross-objection be permitted to be enhanced to the rate of Rs.5000/- per sq. meter thereby totally claiming further enhancement of Rs.4,050/- per sq. meter in the cross-objections.

4. Mr. Patil, learned Additional Government Pleader appearing in the matter submits that no reply is necessary to be filed as the right of the original claimant for enhancement of claim is well settled.

5. Having heard the learned Counsel and having considered their submissions, the Interim Application is allowed in terms of prayer clause (a), which reads thus :

(a) This Honourable High Court be pleased to permit the Applicants to amend and claim compensation at the rate of Rs.5,000/- per square meter thus totally claiming further enhancement of Rs.4,050/- in Cross Objections.

6. Let the amendment be carried out and deficit Court fees, if any, be paid within a period of five weeks.

7. Let the copy of the amended proceedings be served on the other side and an appropriate affidavit of service be filed.

8. The Interim Application accordingly stands allowed and disposed as above.

9. List the First Appeal for hearing on 17^th February 2026.
