1. Mentioned out of turn at the time of rising of the Court.
2. This is an Application seeking relaxation of condition (iv) of the bail order dated 10th March, 2025 for travelling out of Maharashtra without the prior permission of the learned Trial Court.
3. Ms. Sharma, learned counsel for the Applicant, submits that the Applicant is a student who has enrolled for a two year post graduation course in the Master of Tourism and Travel Management with CHRIST (Deemed to be University) at Bangalore in 2022. The academic year has started in June, 2025 and for the time being, the Applicant has been granted permission by the Trial Court to remain in Bangalore from 2nd July, 2025 to 3rd November, 2025. Thereafter, by order dated 4th November, 2025 passed by the Additional Sessions Judge, Belapur, he has also been granted permission to remain in Bangalore to attend classes from 5th November, 2025 to 31st January, 2026. The Applicant has been directed to furnish details of his travel, address of stay in Bangalore city, contact details including mobile number before leave the State of Maharashtra, to the Trial Court. He has also been directed to attend the Court proceedings on the date listed before the Trial Court.
4. Ms. Bajoria, learned APP representing the State, submits that the Applicant is very well able to take permission from the Trial Court to remain in Bangalore for the purpose of attending his classes, as the Trial Court has considered and granted him permission to travel to Bangalore.
5. I have heard learned counsel for the respective parties and perused the record of the case with their assistance.
6. I have perused the Identity Card issued to the Applicant and receipt indicating payment of fees to the University for the said course.
7. Considering the submissions advanced by the learned counsel for the respective parties and averments made in the Application supported by the documents, the interest of justice will be served if the Applicant is permitted to remain in Bangalore from 1st February, 2026 to 30th June, 2026 to attend classes in the CHRIST University at Bangalore, and it is directed accordingly.
8. The Applicant shall attend the local Police Station having jurisdiction over the area in which CHRIST University is situate, on every alternate Saturday between 09:00 a.m. to
02:00 p.m. to mark his attendance.
9. The Applicant is at liberty to make a fresh application seeking extension of time to continue to reside in Bengalore for the purpose of attending his classes for the said course before the Trial Court. He is also at liberty to seek permission from the Trial Court to travel beyond Bangalore and the State of Maharashtra for the purpose of completion of curricular activities as may be mandated by the University.
10. Interim Application is partly allowed in the above terms and is disposed of.
11. Rest of the order shall remain as it is.
