1. Although none appears for the Petitioner, with the assistance of the learned AGP appearing for the Respondent No.2-State of Maharashtra, I have perused the papers.
2. The Contempt Petition has been filed inter alia contending that the order dated 19th July 2021 has not been complied with.
The said order dated 19th July 2021 reads as under:
“1] Mr. Mundargi, learned counsel for the applicant informs that parties have amicably settled the matter and furnished an undertaking to this Court which is taken on record and marked ‘X’ for identification.
2] Learned counsel Mr. Adkine, appearing for the complainant does not dispute the aforesaid position. 3] In the aforesaid background, learned counsel for the applicant makes a motion for withdrawal of the application. Application stands dismissed as withdrawn.
4] However, in the aforesaid background, there shall be no coercive action against the applicant for a period of 8 weeks from today.
5] Since anticipatory bail application is disposed of, all connected pending applications also stand disposed of. ”
3. The contention raised in the Contempt Petition is that the undertaking which has been taken on record by the Court has not been complied with. However, perusal of the order dated 19th July 2021 shows that the said Anticipatory Bail Application has been allowed to be withdrawn and dismissed as such. No effective order has been passed by the learned Single Judge. Thus, there is no merit in the contention raised in the Contempt Petition that the order dated 19th July 2021 has been violated.
4. Accordingly, the Contempt Petition is disposed of in above terms with no order as to costs.
5. However, it is clarified that the Petitioner is at liberty to adopt other appropriate proceedings, in accordance with law. All contentions to be raised in such proceedings, if filed, are expressly kept open.
