The court permitted a stop-gap arrangement for the inventory and disposal of expired goods in a sealed warehouse, following existing advisories, pending the final adjudication of the petition on its merits.

P.C.:

1. Issue notice to the Respondents, returnable on 27.08.2026. This Petition would appear in the urgent supplementary board. The learned Government Pleader waives service of notice on behalf of Respondent Nos. 1 to 4, the State.

2. Let the affidavit-in-reply be filed on or before 20.08.2026.

3. Having considered the submissions of the learned Senior Advocate on behalf of the Petitioners and the learned Government Pleader, the parties have come to an understanding, as a stop-gap arrangement, that the Petitioners would prepare an inventory of all the goods on the shelf which have expired and which are presently inside an effectively sealed warehouse of the Petitioners. The said inventory would be prepared within three days from today. The said inventory would be handed over to Respondent No. 4, who would acknowledge it’s receipt after verifying the expired goods that are being placed in his custody. Thereafter, Respondent No. 4 would follow the Advisory in vogue dated 03.11.2025 and the earlier directives dated 21.12.2020, which are in the Petition paper book, for the purpose of following the prescribed procedure for disposal of perishable, seized and rejected items.

4. Needless to state, the said disposal would be in accordance with the said Advisory. Respondent No. 4 would prepare relevant documentation of the receipt of the goods and destruction thereof, just to complete the records.

5. Let this activity be continued, until we hear this Petition on its merits and pass further orders.
