Mukherjee Ms. Anindita Banerjee … For the Petitioner Mr. Kamalesh Bhattacharya, Sr. Adv., Mr. Aninda Bhattacharya ..For the WBSWC Mr. Sudipto Panda ..For the State The petitioner has been working since October 5, 2016 in the post of Godown-in-Charge/Superintendent of WareHouses with the West Bengal State Warehousing Corporation. The petitioner was engaged on contractual basis for a period of one year from his date of joining.

The said contractual employment was extended by the Secretary, WBSWC till October 24, 2020. Admittedly, show- cause notice was issued against the petitioner on July 16, 2018 for being initially absent during an inspection conducted by the Deputy Director (Procurement and Supplies) of the Food and Supplies Department. Upon reaching the site belatedly, the petitioner also entered into an argument with his superior officer using harsh language and in a raised voice.

The petitioner immediately responded to the said show-cause notice on July 19, 2018 and accepted that such a behaviour would not be repeated in future. The petitioner was also given a warning on August 14, 20
