The court clarified that police are to ensure public peace but not to adjudicate property rights.

R e The petitioner is aggrieved by the fact that the private respondents are attempting to grab her property and also creating inconveniences to the petitioner from entering into her property. The petitioner informed the jurisdictional police station including the superior officers of police, but, till date, no steps have been taken.

State has submitted a report which reflects that the police authorities, after completion of enquiry, have drawn up proceedings under Section 126 /135(3)

of the BNSS .

So far as the accusations of the petitioner are concerned, the police authorities could not unearth any activity relating to consumption of alcohol and gambling at the property which has been referred to in the writ petition. Moreover, a strict vigil has been kept by the police authorities.

Having regard to the fact that the police authorities are not entitled to decide right, title and interest of the property but are obviously empowered to ensure that no breach of the peace and/or tranquility is created in respect of the subject property where two parties are at loggerheads, I direct the police authorities to ensure that no untoward incident results because of the inimical relationship existing between the petitioner and the private respondents.

With the aforesaid observations, WPA 15304 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
