1. The appeal is directed against an order of the Single Bench of this Court dated 16th July, 2025 passed in WPA 8493 of 2025.
2. The admitted facts are that the writ petitioners/appellants submitted tender for upgradation of concrete road, repairing of drain with cover slab from H/O Prabir Bose to Asha Studio, from Alaya Apartment to H/O Somnath Bhattacharjee etc. The work order dated 25th February, 2021 was issued against the quoted amount of Rs. 2,08,42,137/- to the extent of Rs. 37,00,000/-. The balance amount of work was to be ordered later. The appellants submitted a R.A. Bill to the respondent/Bidhannagar Municipal Corporation that appears to have been certified as completed on 31st March, 2022 by the officials of the BMC.
3. A certificate of completion dated 20th November, 2024 was subsequently issued certifying completion of work in the opening statement. Against the actual date of completion of work, however, the expression mentioned “work in progress”. The first R.A. bill s
