Mr. Sumit Roy …WBSEDCL The petitioner claims to have purchased the property in question from Kausik Ghosh and his mother, Smt. Sanaka Ghosh.
It is stated by the petitioner that, subsequent to the said purchase, his name has been duly mutated in the relevant land records.
The petitioner is aggrieved by the refusal of the West Bengal State Electricity Distribution Company Limited (WBSEDCL) to provide an electricity connection in respect of the said premises, allegedly due to objections raised by respondent nos. 4 and 5.
Learned counsel appearing for respondent nos. 4 and 5 submits that a civil suit is presently pending between his clients and the vendors of the petitioner. It is alleged that the transfer of the property in favour of the petitioner was illegal. He claims ownership of respondent nos.4 and 5 over the property.
However, it appears from the materials on record that the petitioner is in settled possession of the property in question. A person in settled possession is entitled to an electricity connection, irrespective of the question of legal title.
