Mr. Amal Kr. Datta … for the Union of India The petitioner is aggrieved by the fact that a sum of Rs. 2.19 lakh (approx) was shown as loan in her account without the petitioner having any knowledge regarding the same which she came to know surprisingly. Consequently, she informed the police station.
State has submitted a report which reflects that Nischinda P.S. GDE No. 432 of 2024 dated 09.01.2024 was recorded and steps have been taken by way of communications being made to different authorities of Axis Bank by the Cyber Crime Police Station, Howrah Police Commissionerate. However, till date, no case has been registered.
Prima facie, it reflects that a case for investigation has been made out. Consequently, the police authorities, if they are confronted with any inconveniences because of carrying out the enquiry in the manner in which they are proceeding, I am of the view that in order to expand the scope and enforce the police powers, a case be registered by the police authorities against unknown persons and investigation, to that effect, be carried out.
Since, presumably, a case would be registered, the learned CJM, Howrah would be in charge of the case.
