The court allowed the petitioner to submit a representation regarding her exam eligibility, emphasizing rights to due consideration.

The petitioner is a student of B.A., LLB 5 year course in the Indian Institute of Legal Studies and appeared for her 5^th semester examination which commenced on 24^th January, 2023. She did not qualify in any of the papers and appeared for the 5th semester examination for the 2^nd time on 30^th January, 2024. In the said examination she qualified in all the papers except “Constitutional Law-II”. She appeared in the 6^th and 7^th semester examinations and qualified in all the subjects.

However, she did not take the supplementary tests for clearance in the subjects in which she did not qualify earlier. When she tried to fill up the online form for appearing in the 8th semester examination she was found to be ineligible to appear for the examination.

The petitioner seeks a direction upon the authority to allow her to appear for the said examination as a special chance.

Learned counsel for the respondents submits that the documents are not clear as to why she was prevented from appearing in the 8^th semester examination.

Learned counsel suggests that the petitioner may submit a comprehensive representation before the concerned authority stating the entire facts and seek necessary permission to appear for the examination, if she is otherwise eligible.

Learned counsel for the petitioner concedes to the said submission.

In view of the above, the writ petition is disposed of with liberty to the petitioner to submit a comprehensive representation before the 2^nd and 4^th respondents in this regard. The petitioner undertakes to submit such representation by tomorrow, that is, 3^rd July, 2025.

The 2^nd and 4^th respondents shall consider and dispose of the representation by 7^th July, 2025 upon affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law.

However, there shall be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
