The court emphasizes the statutory mandate for timely progress updates in investigations under the BNSS.

Mr. Avirup Chatterjee Mr. Rishov Das … for the respondent no. 6 R e The petitioner preferred an application under Section 175(3) of the BNSS.

Consequent to the direction passed by the learned Magistrate, a case being Netaji Nagar P.S. Case No. 90 dated 20.04.2025 was registered for investigation under the relevant provisions of the BNS .

The petitioner complains that till date the stolen articles have not been recovered and the police authorities are not progressing with the investigation of the case.

Learned advocate for the respondent nos. 5 and 6 submits that they are the tenants who have been falsely implicated in connection with the present case.

Rebutting such contentions, learned advocate for the petitioner submits that because of his absence for a limited period of time, the petitioner has been facing with severe consequences and all his articles have been removed from his possession.

State has submitted a report which reflects that the case has been registered on 20^th April, 2025.

In view of the case having been registered on 20^th April, 2025, the period of 90 days would be completed within a short period of time.

Accordingly, the investigating officer of the case would notify the defacto- complainant relating to progress of the investigation, the steps taken and the inconveniences so faced for not taking the investigation to its logical conclusion.

In case, the report is not received by the complainant, the complainant would invoke the statutory provisions before the learned Magistrate thereby compelling the investigating officer to advance copy of the progress report which is a statutory mandate under the BNSS, 2023.

The police authorities are further directed to take the investigation to its logical conclusion, and to that effect, if required, may seek assistance of their superior officers.

With the aforesaid observations, WPA 12648 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
