The present writ petition has been filed against the respondents alleging illegal detention of migrant workers from the State of West Bengal and seeking issuance of a writ of habeas corpus directing release of the writ petitioner’s relatives, namely, Sweety Bibi (in short, Sweety), Kurban Sheikh (in short, Kurban) and minor son, namely, Imam Dewan (in short, Imam) forthwith and to produce them in Court.
Mr. Chakraborty, learned advocate appearing for the petitioner submits that Bengali speaking people have been illegally detained in New Delhi. Sweety and Kurban are migrant labourers, employed and working at Rohini, New Delhi had been illegally detained beyond 24 hours without being produced before any Court of law on the basis of suspicion that they are Bangaladeshis since they speak Bengali and the Delhi Administration did not even cross-check their identity. Such act is violative of the fundamental rights.
Mr. Roy, learned Government Pleader assisted by Mr.
Basu Mallick, learned Additional Government Pleader submits that necessary steps are being taken by the State authorities to avail instructions from the Delhi Administration and the Union of India.
