WPA 18610 of 2024

Court addressed the adequacy of investigation findings and transfer requests in a writ petition context.

Headnote:A writ petition filed concerning the assessment of investigation outcomes by AIIMS, Kalyani, and the request for its transfer was deemed unnecessary. The court concluded that no further directions were warranted after determining no signs of assault were present from the evidence. The affidavits are required for subsequent hearing scheduling.

The petitioner has also advanced a prayer for transfer of the investigation.

Having considered the same, the respondents are directed to file their Affidavit-in-opposition preferably by 21st August, 2025. Affidavit-in-reply, if any, be filed by 29th August, 2025.

List the writ petition under the heading ‘Hearing’ in the monthly list of September, 2025, when the State would submit a progress report.

Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
