The Court: GA 2 of 2022 was filed by the Defendant Nos. 1(a) to 1(d), praying for a) revocation of leave granted under Clause 12 of the Letters Patent, b) dismissal and/or rejection of the plaint, c) stay of the further proceeding of the instant suit pending disposal of the present application.

The sum and substance of the contention in the instant application is that the instant suit has been filed by the Plaintiff for recovery of a sum of money arising out of a transaction related to agreement for sale dated 13/12/2016. The agreement for sale was executed in respect of a land which is situated as well as the agreement was executed at Gandhidham, District-Kutch in the State of Gujrat outside the jurisdiction
