1. The present challenge has been preferred against the order of a learned Single Judge passed in a writ petition whereby the appellant had challenged a decision taken by the Commissioner of the Siliguri Municipal Corporation, directing the appellant/occupant of the concerned building to furnish a structural inspection report on a „Push Over Analysis‟ from an empanelled engineer.
2. Learned counsel for the appellant argues that, within the contemplation of Section 268 of the West Bengal Municipal Corporation Act, 2006 , which is the relevant provision in the present case, in the event the Commissioner, upon any information in his possession, is satisfied that any building is “unfit for human habitation” and is not capable, at a reasonable expense, of being rendered fit, he shall serve upon the owner of the building and upon any other person having an interest in the building, whether as a lesse
