1. The petitioner participated in the 2^nd SLST-2025 conducted

by the West Bengal Central School Service Commission in

respect of classes- ‘IX’, ‘X’ & ‘XI’, ‘XII’. She claims to be a

member of the scheduled tribe community. She paid the

application fees meant for the reserved category candidates i.e.

rupees two hundred. The authority treated her application in

the general category.

2. She is aggrieved by the same.

3. The judgment passed by the Hon’ble Division Bench on

16^th December, 2025 in MAT 2115 of 2025 in the matter of

The West Bengal Central School Service Commission & Ors.

Vs. Somnath Pramanik & Ors. has been placed before this

Court.

4. It appears therefrom that the Court directed the

Commission to open the portal for updating the categorization

of the candidates who filed writ petition in this regard upto

2.30 P.M on 16^th December, 2025. The portal was directed to

remain open till 6.00 P.M. on 17^th December, 2025.

5. The Court clarified that the direction was limited to persons

who approached the Court till 2.30 P.M. on 16^th December,

2025 by way of filing a writ petition or appeal or otherwise.

6. The present writ petition was affirmed on 16^th December,

2025 before the Circuit Bench at Jalpaiguri and it was filed on

17^th December, 2025.

7. It has been submitted that the order passed by the Hon’ble

Division Bench sitting in the principal seat was not known to

the party at the Circuit Bench. As the writ petition was

affirmed prior to delivering the judgment by the Hon’ble

Division Bench on 16^th December, 2025, the prayer of the

petitioner for being treated as candidate of the reserved

category may be considered sympathetically by the

Commission.

8. In respect of the classes- ‘IX’, ‘X’, the petitioner updated

her caste category details in response to the window provided

by WBCSSC on 17^th December, 2025 at 11.13 A.M.

9. Learned senior counsel representing the Commission

submits that the Commission took steps in terms of the

direction passed by the Hon’ble Division Bench. The portal

was opened by the Commission for the period as stipulated by

the Hon’ble Division Bench.

10. Upon hearing the parties it appears that, admittedly, the

petitioner who is here at the Jalpaiguri Circuit Bench did not

have the opportunity to know the order passed in the Principal

Bench on 16^th December, 2025. The writ petition was indeed

affirmed on 16^th December, 2025 but filed on 17^th December,

2025 before the Circuit Bench.

11. As regards the application of the petitioner for classes-

‘IX’, ‘X’, the petitioner claims to have already updated her

category details on 17^th December, 2025 at 11.13 A.M.

12. The Commission is, accordingly, directed to take a decision

in respect of the caste category of the petitioner in connection

with her appearance in the examination for classes XI and XII

at the earliest keeping in mind the direction passed by the

Hon’ble Division Bench, especially in view of the fact that the

petitioner is not located within the principal seat of the High

Court at Calcutta.

13. The Commission shall also keep in mind that an examinee

ought not to be treated in two different categories in an

examination. The candidature of the petitioner shall be

ascertained from the caste certificate relied upon by her.

14. The writ petition stands disposed of.

be supplied to the parties upon compliance of all requisite

formalities.
