1. Affidavit-of-service filed on behalf of the petitioner is taken on record.
2. The issue arising for consideration in this matter is twofold. Firstly, whether, in absence of a functional West Bengal Administrative Tribunal (hereinafter in short referred to as the “Tribunal”) for want of any judicial or administrative member, the petitioner is entitled to invoke the jurisdiction of this Court under Article 226 of the Constitution of India before this Division Bench having determination with respect to “matters relating to State Tribunals under Articles 323A and 323B of the Constitution of India”.
3. The second issue is whether the petitioner is entitled to be considered in the process of recruitment set in motion by an advertisement brought out by the Government of West Bengal on
01.12.2025 for appointment of Professor, Associate Professor and Assistant Professor.
