It is submitted by the learned advocate for the

alleged contemnor, who is also the respondent no.4 in

the writ petition that notices are being sent to the writ

petitioner as well as his advocate but they have neither

appeared nor sought for any adjournment of the

hearing.

It has, therefor, become impossible to carry out

the hearing in terms of the order dated 21st November,

2025.

The alleged contemnor/respondent no.4 is

personally present in Court today.

It is submitted by the learned advocate for the

petitioner that notices are issued giving a very short

time to attend the hearing and, as such, it is not

possible for the petitioner, who is presently residing in

Paschim Burdwan to attend.

Be that as it may, in order to avoid any

controversy since the alleged contemnor/respondent

no.4 in the writ petition is personally present and the

petitioner is represented by his advocate, a date of

hearing is fixed with the consent of the alleged

contemnor/respondent no.4 as also the learned

advocate for the petitioner.

The petitioner shall appear before the alleged

contemnor/respondent no.4 in the writ petition on 29^th

December, 2025 at the office of the alleged

contemnor/respondent no.4 at Power House Complex,

Burdwan -713101 at 2:00 PM along with all documents

and records in support of his claim for the hearing to

take place on that date.

All other directions contained in the order dated

21^st November, 2025 shall be complied with.

Although, no further notice is required by way of

abundant caution, the alleged contemnor/respondent

no.4 shall formally communicate the date of hearing to

the learned advocate for the petitioner and other stake

holders for the hearing. The appearance of advocates to

represent the petitioner and the respondent is only

permissible if the respondent no.4 in the writ petition so

decides.

It is made clear that no further excuse either from

the side of the alleged contemnor/respondent no.4 or

from the side petitioner shall be considered for not

having the hearing to take place on 29^th December,

2025 at 2:00 PM at the office of the alleged

contemnor/respondent no.4 at Power House Complex,

Burdwan -713101.

The matter is adjourned and shall appear on 30th

January, 2026.
