1. Affidavit of service filed in Court today is taken on record.

2. Heard the parties through their respective learned counsels.

3. The petitioner in the instant case is a holder of Permanent Stage Carriage Permit being P.St.P. 06/74-75 initially granted on the route Bardhaman to Tarkeswar and subsequently by a resolution of respondent no. 2 dated 17.01.2018 the route has been described as Memari to Tarkeswar which was accordingly renewed upto 22.09.2029 endorsing the Stage Carriage No. WB-19J-2448.

4. The petitioner states that the respondent no.

4 is also a permit holder on the same route plying from Memari to Tarkeswar under P.St.P. No. 17/22-23 and has been operating his Stage Carriage on the said route by virtue of an existing time table and has been authorized to depart his vehicle in the last trip from Tarakeswar at 4:50 PM with the termination of service at Jamalpu
