1. The petitioners have field the present writ application praying for a direction upon the respondents/authorities for release of the payment due to the petitioners.
2. This Court finds that there is no dispute with regard to the payment of dues by the respondents to the petitioners. It is submitted that the petitioners have already received the principal amount but the authorities have not paid the interest.
3. Learned counsel for the respondents submits that due to the non-availability of fund, it is not possible for the authorities to pay the interest as claimed by the petitioners.
4. This Court finds that the authorities have paid the principal amount but have not paid interest. This Court finds that initially the petitioners have filed the writ application before this Court and by an order dated January 21, 2021 this Court has disposed of the writ application by directing the Executive Officer, Bagdah Panchayat Samiti, Bagdah to take steps for consideration of the representation strictly in accordance with law within a period of eight weeks. In compliance of the order passed by this Court the Executive Officer passed an order dated March 4, 2021 holding that the petitioners are eligible to get the payment after scheduled deduction. Subsequently, several authorities have passed an order for release of the payment but the payment was not released. Accordingly, the petitioners have filed the writ application.

In the writ petition, this Court has directed the Executive Officer to appear before this Court in-person as in spite of several directions passed by the higher authority, the Executive Officer had not released the amount. Accordingly, the Executive Officer has given an undertaking before this Court to release the amount and now the principal amount has been released but no interest has been paid.
6. Considering the above, the writ petition is disposed of by directing the respondent no. 10, the Executive Officer, Bagdah Panchayat Samiti, Bagdah to release the interest at the rate of 9% per annum from April 1, 2021 till December 12, 2025 within a period of three months from the date of receipt of this order.
7. It is made clear that within the period of three months if the rate of 6% per annum till the total interest is paid on principal amount.
8. WPA 15134 of 2025 is disposed of.
9. Urgent Xerox certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
