1. Affidavit of service filed in Court today is taken on record.

2. This Court has considered the purported affidavit of compliance of the respondent nos. 1, 2 and 3. Far from showing compliance at paragraph no. 11 of the affidavit it has been averred as follows:-

“Para-11. That, other benefits like revision of pay fixation on promotion as Deputy Superintendent of Police and Additional Superintendent of Police in CBI will be given in due course as deemed fit.”

3. The contemnors have, therefore, unequivocally admitted to having committed Contempt of this Court.

4. This Court does not find even a suggestion of apology on the part of the contemnors in the purported affidavit of compliance.

5. Across the bar, it is submitted by the learned counsel for the alleged contemnors that the petitioner has been promoted to the post of ASP w.e.f. 11^th June, 2022. A document dated 22^nd October, 2025 regarding pay fixation of the applicant is also indicated. Copy of the same has been handed over to the petitioner.

6. It is not known as to whether any further financial benefit payable to the petitioner has been released pursuant to the promotion. Paragraph 11 set out hereinabove indicates that the same has not been done.

7. It appears that the Pension Payment Order to the petitioner has been issued at the pay scale much prior to his being promoted as ASP, i.e., in the pay scale when he was Inspector.

8. The inordinate delay on the part of the alleged contemnors is itself glaring and shocking. The order of which contempt is alleged was passed on 1^st February, 2024.

9. It is clear and explicit that the contemnors have no respect to dignity and majesty of this Court or the orders passed thereunder. The alleged contemnors have shown flagrant disrespect to orders of this Court and have sought to lower the dignity of this Court.

10. The alleged contemnors shall appear virtually before this Court and explain why they should not be committed to prison to or otherwise suitably dealt with for having deliberately and willfully committed Contempt of Court, in the manner indicated above.

11. List the matter on 16^th January, 2026 at 2.00 p.m. 12. The pendency of the proceeding shall not prevent the alleged contemnors from complying with this Court’s order, in its totality.

13. List the matter accordingly.
