1. Matter relates to transfer of the petitioner on medical

ground since petitioner is suffering from gynaecological disorder. An application for transfer was made by the petitioner on Utsashree portal on 8^th December, 2021 and same ultimately reached the concerned authority of West Bengal Central School Service Commission through portal on 10^th January, 2022 after being forwarded by the District Inspector of Schools (S.E.), Birbhum. Grievance of the petitioner is

till date her transfer application is not decided.

2. A report was submitted on behalf of the District

Inspector of Schools (S.E.), Birbhum being respondent no.3 dated 25^th July, 2025 wherefrom it appears that the post which was preferred by the petitioner in her

transfer application was also preferred by another candidate, namely, Sumita Saha.

Learned advocate representing the West Bengal Central School Service Commission submitted that since Sumita Saha’s transfer application was not forwarded to the Commission, decision could not be taken on her transfer application. However, in the report dated 25^th July, 2025 it is disclosed by the respondent no.3 that medical report in connection with transfer application of said Sumita Saha was not found favourable as a result whereof Sumita Saha’s transfer application was sent back to the respective school.

4. Today on instruction it is submitted on behalf of the Commission as Sumita Saha’s transfer application was sent back to the school authority, there is no impediment at present to consider the transfer application of the petitioner.

Taking note of the report dated 25^th July, 2025 of the respondent no.3 and the submissions made on behalf of the Commission, writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission being respondent no.7 to decide with law, within a period of six (6) weeks from the date of communication of this order. Decision to be taken by the respondent no.7 shall be communicated to the petitioner by fortnight thereafter.
