1. Both the Learned Advocates representing the appellant/

Insurance Company and the respondents/claimants are present in

Court.

2. The instant appeal had been filed against the judgment and

award dated 09.01.2024 passed by the Learned Additional District Judge, Motor Accident Claims Tribunal, 1st Court, Paschim

Medinipur in M.A.C. Case No. 572 of 2014.

3. The learned advocate representing the appellant/Insurance Company submitted to have filed the instant appeal on the ground that the owner of the offending vehicle did not possess a valid route permit for plying the offending vehicle being a truck bearing registration number WB-33A/2922. Moreover, in absence of any corroborative oral or documentary evidence, the monthly income of the victim had been assessed to be Rs.6,000/- who claimed to have been a helper of the truck
