1. Affidavit-of-service filed on behalf of the petitioner is taken on record.

2. Matter is heard in presence of the learned advocates representing the

petitioner and Union of India.

3. On measuring height of the petitioner by the concerned respondent authority in terms of the order passed by a coordinate Bench on 3^rd October, 2025 on a writ petition being WPA 22433 of 2025 it was found that height of the petitioner is 169.8 cm.

It is contended on behalf of the petitioner that since deficiency of height is less than 0.5 cm as requisite height is 170 cm petitioner is entitled to get the benefit of relaxation as contemplated in Clause 2(d) of the Guidelines for Recruitment Medical Examination in Central Armed Police Forces and Assam Rifles of May, 2015.

Ms. Alam, learned advocate representing the Union of India has opposed this writ petition since requisite height for declaring candidate eligible to be considered for appointment in the post of Constable GD is 170 cm. On measurement petitioner’s height was found 169.8 cm which is less than 170 cm.

6. On perusal of relevant part of Clause 2(d) of revised guidelines it appears that relaxation is permitted and it is found here that the deficiency of height is less than 0.5 cm taking note of the requisite height i.e. 170 cm.

7. In the present case concerned respondent authority measured the height of the petitioner 169.8 cm which is less by 0.2 cm than requisite height. Therefore, it is found that petitioner is entitled to get the benefit of Clause 2(d) wherein provision of relaxation in height is contemplated to the extent of 0.5 cm.

Having considered the submissions made on behalf of the parties and taking note of the relevant provisions as contained in the revised guidelines, concerned respondent authorities are directed to consider the petitioner as an eligible candidate in terms of height and consider his appointment in the post of Constable GD, if petitioner is found otherwise eligible.

9. Aforesaid exercise shall be carried out by the concerned respondent authorities within a period of six weeks from the date of communication of this order.

10. The writ petition stands disposed of.

11. There shall be no order as to costs.

12. Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
