1. This writ petition had been filed challenging an

order of temporary delisting dated August 17, 2021 that had been passed after issuance of a show- cause notice dated April 21, 2021. The writ petition was admitted and an interim order was passed on August 10, 2022 thereby restraining the respondents from giving any effect or further effect to the notice to show cause dated April 21, 2021 as well as the order of temporary delisting dated

August 17, 2021.

2. During pendency of the writ petition a further

issued. It is submitted by both the parties that the 29, 2021 encapsulated the same charge based on

21, 2021 had been issued.

3. The petitioners replied to the said notice to show cause dated December 29, 2021. Upon considering the petitioners’ reply, the respondent authorities have, by a letter dated October 8, 2025, closed the show-cause notice dated December 29, 2021 observing as follows: -

4. “After scrutiny of these replies competent authority has approved the following: -

i. Closure of show cause notice dated-

29.12.2021, issued to M/s Eldyne Kolkata and M/s Thales Germany (OEM).

ii. This closure shall not confer any right or claim whatsoever on the firm against the department. Further this closure does not affect the rights of the department in any other matter and shall not give the firm any right or claim in any forum or proceeding.”

The said letter dated October 28, 2025 has been brought on record by the petitioners by filing CAN 8 of 2025 with a prayer to pass an order disposing of the writ petition upon recording that the respondents’ letter dated October 8, 2025 closes the subject matter of the show-cause notice dated December 29, 2021 and the same be also considered as a closure of the show-cause notice dated April 21, 2021.

6. It is not in dispute before the Court that the subject the show-cause notice dated April 21, 2021 is the same. The show-cause notice dated December 29, 2021 has already been closed. In such view of the matter, nothing survives to be decided further in this writ petition.

7. With the aforesaid observations, WPA 13026 of

2021 stands disposed of.

8. CAN 8 of 2025 also stands disposed of accordingly.

9. There shall, however, be no order as to costs.

10. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible.
