1. Matter is heard in presence of the learned

advocates representing the petitioner and

Union of India.

2. Question is in connection with selection

process which was initiated pursuant to the Recruitment Notification dated 15th March, 2023 petitioner is to be adjudged as a candidate who belongs to Economically

Weaker Section (EWS) or not.

3. From the materials available on record and

the submissions made on behalf of the parties it appears that as per Recruitment Notification dated 15th March, 2023 petitioner applied for the post of Constable-Bugler under EWS category. As per said notification dated 15th

March, 2023 last date of submitting OnLine application for offering candidature was 25th April, 2023 and if petitioner was found to be shortlisted date for document verification was fixed on 15th July, 2024.

Indisputably petitioner had EWS certificate dated 18th May, 2022 for the financial year 2022-2023 and there was subsequent renewal of EWS certificate on 5th November, 2024 which was in respect of financial year 2024- 2025. Therefore, it appears that at the time of submitting OnLine application pursuant to Recruitment Notification dated 15th March, 2023 petitioner did not have valid EWS certificate taking note of the fact that last date was fixed for submitting application was 25th April, 2023. At the time of document verification on 15th July, 2024 petitioner did not have EWS certificate since renewal was made on 5th November, 2024 for the financial year 2024-2025.

5. Taking cue from the submission made on behalf of the petitioner, if Court proceeds on the premise that pursuant to Recruitment Notification dated 15th March, 2023 if petitioner submitted application in between

27th March, 2023 and 31st March, 2023, he might have EWS certificate, but what is striking that at the time of document verification on 15th July, 2024 petitioner did not have valid EWS certificate taking note of the fact that renewal was made on 5th November, 2024.

6. As the petitioner submitted OnLine application for offering his candidature for the post of Constable-Bugler under EWS category and on the date of document verification petitioner did not have valid EWS certificate, no relief can be granted to the petitioner.

7. Writ petition stands dismissed.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
