1. Affidavit of service filed in Court is taken on

record.

2. The petitioner participated in the 2nd State

Level Selection Test, 2025 declaring herself to be a

member of the reserved category.

3. She is aggrieved as the West Bengal Central

School Service Commission considered her candidature

under the ‘General Category’.

4. According to the petitioner, she qualified

under the category OBC-A, OBC-B and OBC-Female,

but she is one mark short of the cut-off marks in respect of general category candidates.

5. The petitioner contends that her caste sub-

category got changed in view of the change made by the Labour Department. The petitioner initially declared herself to be a member of the Goala, Gope community but thereafter she disclosed herself to be the candidate of Sadgope/Sadgop sub-category. The petitioner asserts that she was not provided any option for disclosing her Goala sub-category.

Learned senior counsel representing the Commission contends that the petitioner herself declared to be a member of the Sadgope/Sadgop sub- category but she was unable to produce any certificate declaring her sub-category as Sadgope/Sadgop. She has, accordingly, been treated under the general category.

7. Whether the action of the Commission in treating the petitioner under the general category despite her declaring to be a member of the OBC category has to be adjudicated.

8. Let affidavit-in-opposition be prepared and circulated within three weeks from date. Reply, if any, be filed within a week thereafter.

9. The candidature of the petitioner shall abide by the result of the instant writ petition.

10. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.
