1. Affidavit of service filed on behalf of the petitioner in Court today be kept with the records.

2. The petitioner participated in 2^nd SLST 2025 in the OBC-A category. She submits that she is a physically handicapped candidate with benchmark disability. Due to inadvertence, her disability was not disclosed in the application form. She realized the mistake only at the time of credential verification when she has been treated as general category candidate instead of a reserved one.

The petitioner relies on the judgment dated December 16, 2025 passed by the Hon’ble Division Bench of this Court in MAT 2115 of 2025 (The West Bengal Central School Service Commission & Ors. vs. Somnath Pramanik & Ors.) wherein the Court directed the Commission to open the portal for updating the categorization of the candidates.

4. It has been submitted that the Commission acted in terms of the said order to publish the notification for updating categorization only in the old website and not in the new one. There was no publication in the newspaper for which the petitioner was unable to update her category.

5. It has been submitted that there is one post still vacant in the physically handicapped category for the subject Nutrition (PG) in Class XI-XII level.

6. Prayer has been made to direct the Commission to consider the candidature of the petitioner in the reserved category meant for physically handicapped candidate.

7. The submissions and the prayer of the petitioner have opposed by the Commission.

8. It has been submitted that the intimation letter for oral interview and lecture demonstration issued in favour of the petitioner clearly recorded her category as OBC-A. Prior to appearing in the interview, the petitioner did not raise the issue of change of category. It is only after the petitioner was unsuccessful to secure a position in the merit list, the instant writ petition has been filed seeking benefit of reservation under the physically handicapped category.

9. The Commission issued at least three notices dated July 30, 2025, August 5, 2025 and September 22, 2025 granting opportunity to the candidates to change their category. The petitioner failed to do so.

The Commission opened its portal for updating the categorization of the candidates on December 17, 2025. Even at that stage, the petitioner failed to change her category.

10. The instant writ petition has been filed only on February 5, 2026 praying for a direction upon the Commission to treat her as a physically handicapped category candidate.

11. Such prayer of the petitioner cannot be accepted at such a belated point of time.

12. The Court is not inclined to interfere in the instant writ petition.

13. The writ petition fails and is hereby dismissed.

14. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
