1. Affidavit of service filed in Court today is taken on record.

2. In the instant case, the petitioner has challenged the validity of certain Rules of the Life Insurance Corporation of India Service) Rules, 2009 on the ground of being ultra vires to the Constitution of India.

3. The petitioner has also assailed the provision of the Life Insurance Terms & Conditions of Service) Amendments Rules, 2016.

4. The petitioner has prayer for quashing the impugned notifications dated 12^th November, 2009 and 22^nd January, 2016 issued by the Ministry of Finance, Government of India.

5. The petitioner is a Development Officer of the Life Insurance Corporation of India. A show cause letter was issued against him on

2^nd January, 2026.

6. The petitioner is aggrieved by the same.

7. It has been submitted that the provision relying on which the said show cause letter has been issued is ultra vires the Constitution of India.

8. The issue raised in the writ petition has to be decided upon exchange of affidavits.

9. The respondents are directed to file affidavits in opposition within a period of four weeks from date. Reply, if any, be filed within two weeks thereafter.

10. Let the matter be listed for hearing after completion of affidavits.

11. There will be an interim order to the effect that the proceeding that has been initiated against the petitioner may continue, but no final order will be passed without taking the leave of the Court.

12. Reliance has been placed on the order passed by the Hon’ble Division Bench on 3^rd September, 2024 in MAT 1224 of 2024 in the matter of Life Insurance Corporation of India Vs. Amit Kharat & Ors. where the Hon’ble Division Bench was pleased not to interfere with the similar orders passed by the learned Single Judge.

14. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
