Heard learned counsels for the parties.
It appears that the petitioner has married co-accused Debasis Sarkar and has applied for registration as a citizen of India under Section 6B of the Citizenship Act, 1955. The application is pending. Charge sheet has been submitted. Her further detention is not required for the purpose of custodial interrogation. She may be released on bail.
Accordingly, the prayer for bail is allowed.
The petitioner namely Jaba Sarkar @ Jaba RaniSarkar shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Mathabhanga, Cooch Behar subject to condition that she will remain within the jurisdiction of the learned trial Court and shall appear before the learned trial Court on every date of hearing fixed by the learned trial Court. She shall not tamper with evidence or intimidate witnesses in any manner whatsoever.
