The petitioner has approached this court being aggrieved by the progress of the investigation.

On the earlier occasion, it was pointed out that the State is not progressing with the trial of the case. The agony expressed by the petitioner is that he is going to retire on 30^th April, 2026.

Prima facie, it reflects that from 2023, there has been no progress in the trial of the case, as the original case diary was not made available to the newly appointed Public Prosecutor in the trial court.

Mr. Luksom, learned advocate, appearing for the State submits that he has been handed over with the original case diary.

Learned advocate for the State would make necessary arrangements so that the original case diary is handed over to the learned Public Prosecutor presently engaged by the State to conduct the trial.

The investigating officer of the case or, in the alternative, the Inspector-in-charge of Haldibari police station would obtain an acknowledgement from the newly appointed Public Prosecutor conducting the trial in respect of receipt of the case diary and keep the same with the records of the police station.

So far as the trial of the case is concerned, next date has been fixed on 16^th April, 2026. The learned trial court is directed to fix a schedule consisting of four dates in a month and not to give any unnecessary adjournment to any of the parties.

It is reiterated that since the case commenced in the year

2013 and more than 12 years have passed in the meantime, all efforts be exerted to conclude the trial within 20 scheduled dates fixed by the learned trial court.

The Investigating Officer of the case or, in case, he is not available, in that case, the Inspector-in-charge of Haldibari police station would pray for issuance of process against the CSW 10, namely, Dr. Siba Prasad Roy, who was, at the relevant point of time, the medical officer of Haldibari Rural Hospital. The learned trial court would, on such prayer, immediately issue summons. The concerned Inspector-in-charge of Haldibari Police Station, if required, will seek assistance from the Superintendent of Police, who would communicate with the Health Department for tracing out Dr. Siba Prasad Roy who, at the relevant point of time, was attached to Haldibari Rural Hospital and has been cited as CSW-

10 of the instant case.

The learned trial court would scrupulously follow the directions and put in efforts so that the Judgment of the case is pronounced by 9^th October, 2026.

With the aforesaid directions, CRR 604 of 2025 is disposed of.
