Mr. Sayan Banerjee Ms. Suparna Dutta Ms. Tusi Naskar ..for the Petitioner Mr. Susovan Sengupta Mr. Dwaipayan Sanyal ….for the State Affidavit of service filed by the petitioner and report submitted by the State are taken on record. The petitioner is a member of the ruling political dispensation and has been elected as President of the West Bengal Krishan Khet Majdur Trinamool Congress on provisional basis. The petitioner apprehends threat to his life and property since he was threatened on several occasions by a rival faction of the same dispensation. The petitioner seeks deployment of security personnel for his protection on payment of the requisite costs.

petitioner before the police authority, enquiry was held and no complaint of cognizable offence was made out. However, the police authority has undertaken to extend police assistance to the petitioner as and when required.

Learned counsel for the petitioner submits that the petitioner intends to submit a comprehensive representation before the Superintendent of Police, Baruipur Police District demonstrating reasons which necessitate deployment of police personnel for protection of his life and property. Such application being filed, the Superintendent of Police, Baruipur Police District shall deal with the application and assess the threat perception of the petitioner in the circumstances given in the representation. The Superintendent of Police, Baruipur Police District shall, in an appropriate situation/circumstance, deploy security personnel for the petitioner upon such costs being borne by the petitioner. The police authority shall be responsible for the safety and security of the petitioner and shall be responsible for any threat/attack on him.

The writ petition is disposed of.

There shall, however, be no order as to costs.

Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
