1. Affidavit of service filed on behalf of the petitioner is taken on record.
2. On the prayer of the learned advocate appearing for the petitioner, leave is granted to correct the name of the school in paragraph nos. 2 and 3 of the writ petition.
3. By the present writ petition, the petitioner seeks for direction upon the respondent authorities for transfer to a school nearby her residence upon consideration of her representation dated 27th October, 2025.
4. The petitioner contends that she is an Assistant Teacher at Paschim Dongajara F.P. School, under South 24 Parganas District Primary School Council, Circle Kultali. The petitioner has joined the said school in the year 2017 and has already completed 5 years of service. The petitioner has to travel about 60 kms. The petitioner is suffering from various diseases including colon ulcer. On 27th October, 2025, the petitioner made representation before the appropriate authority seeking for his transfer. However, the same is still pending consideration. Hence, this writ petition.
5. Mr. Ratul Biswas, learned advocate appearing for the petitioner submits that the matter be relegated to the appropriate authority for consideration of the representation of the petitioner dated 27th October, 2025 for her transfer to a school nearby to her residence.
6. Mr. B. P. Vaisya, learned advocate appearing for the DPSC, South 24 Parganas also submits that the matter be sent to the appropriate authority for due consideration.
7. In view of the submissions advanced by the respective parties, respondent no. 4, the Chairman, District Primary School Council, South 24 Parganas is directed to consider the representation of the petitioner dated 27th October, 2025 and dispose of the same in accordance with law by passing a reasoned
communication of this order subject to furnishing of
all relevant documents by the petitioner
8. The reasoned order shall be communicated to the
such order.
9. Respondent no.4 shall be at liberty to seek for medical examination of the petitioner, if so required, prior to consideration of the representation.
10. Learned advocate for the petitioner is directed to communicate this order to respondent no. 4, the Chairman, District Primary School Council, South 24 Parganas for necessary compliance.
11. With the above directions, the writ petition being no.
WPA 26808 of 2025 stands disposed of.
12. Since no affidavits have been called for, the allegations made in the writ petition are deemed to be not admitted.
13. Consequently, connected applications, if any, also stand disposed of.
14. Interim orders, if any, stand vacated.
15. There will be no order as to costs.
16. Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities.
