1. Let affidavit-of-service, as filed in Court, be kept on record.

2. The petitioner is a student of B.Sc. (Honours) at the Gour Banga University. She took admission in the 2021-22 Session and ought to have passed out with a degree in 2023.

3. However, the petitioner was unable to clear the Advanced Algebra Paper and appeared in two supplementary examinations for the same. However, she was unable to successfully clear the supplementary examinations as well.

4. The petitioner had been taken seriously ill during the course of the supplementary examinations and was admitted to the hospital on account whereof she was unable to clear her paper and appear in the examinations.

5. Ms. Bhowal, learned Advocate appearing for the petitioner, submits that the petitioner ought to be given one further chance, as stipulated in the guidelines prescribed by the University Grant Commission (in short “UGC”).

6. Mr. Chaudhuri, learned Advocate appearing for the University, submits that in similar matters, on earlier occasions, this Hon’ble Court had declined any relief.

It appears that the order in WPA 10255 of 2025 (Sarif Mondal vs. The State of West Bengal & Ors.) had been passed in respect of Kazi Nazrul University, the rules and regulations whereof are not before this Court and hence the same cannot be considered in the instant writ petition which relates to the Gour Banga University, which has its own set of rules and regulations.

8. It is true that the petitioner has been unsuccessful in obtaining her degree in B.Sc. (Honours) only on account of her failure to clear the Advanced Algebra Paper. However, the guidelines, prescribed by the UGC, do not arm the petitioner with any right but merely gives a discretion to the University to extend the attempts by the unsuccessful candidates for one more year, in excess of the stipulated normal plus two years.

9. Since the question of the petitioner’s career is involved and there is a discretion lying with the University, I direct the petitioner to make an appropriate representation by January 28, 2026 with the respondent no. 6.

10.Respondent no. 6 will decide on the representation by January 29, 2026 and intimate the petitioner by January 29, 2026, as to whether a further year’s opportunity would be given to her or not.

11.In the event the respondent no. 6 decides that such opportunity may be given, the petitioner will be entitled to file the online application by January

30, 2026 with a late fine/charge, as stipulated.

12.This order will not create any equity in favour of the petitioner.

13.Respondent no. 6 will proceed to deal with the representation without being influenced by any observations made in this order.

14. With the aforestated directions, the writ petition is disposed of.

15. There shall, however, be no order as to costs.

16. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
