1. The petitioners are aggrieved that their pay band was designated under the 2nd Modified Assured Career Progression (MACP) Scheme. Both petitioners retired as Deputy Registrar of the University after working for almost 15 years. The years of service clearly disentitled the petitioners to be designated under the pay band of 2nd MACP Scheme. Thus, aggrieved with such classification, the petitioners have approached this Hon’ble Court by the present writ petition.
2. The petitioners received certain financial benefits, not under the MACP Scheme, but on account of 6th Pay Commission. The University had taken this enhancement of pay and sought to transpose the same in consonance with the UGC letter of July 9, 2010 thereby contending that all promotions, time bound promotions, in-side promotions, upgradation etc. resulting in financial benefits of higher pay scales, have to be adjusted against the MACP Scheme.
